Terms and Conditions for Africa Rising 6, an event organized by IAA

This website is owned by IAA: International Advertising Association, 511 Avenue of the Americas, #4017, New York, NY, 10011 By using this Website (“Website”), you indicate your understanding and agreement to be bound by these terms and conditions (“T&C”). If you do not agree to any part of these T&C, please do not use this Website and exit any page immediately. Your continued use of the Website constitutes your agreement to all such terms, conditions, and notices and their further amendments or modifications from time to time. The T&C apply to this Website, mobile applications and also, where applicable, to the other services IAA is offering, including to any event(s) promoted herein (collectively with the Website referred as the “Services”) and set out the terms, conditions and notices under which the Services are offered, including but not limited to the use of this Website between IAA and you when you visit and/or purchase a ticket or register and/or participate in any event(s) organized by IAA. IAA reserves the right, but shall be under no obligation to adapt, update, transform and/or modify the T&C or the Privacy Policy and the Website or to introduce new pages, options, services, functions and/or features. The term Website shall include all of these unless otherwise indicated. The T&C do not apply to the content of third parties’ websites or services. The Services are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your continued use of the Services constitutes your full agreement to all such terms, conditions, and notices and any further amendments. You acknowledge and agree to comply with the T&C together with our Privacy Policy available here and any other guidance IAA may issue in supplement from time to time.

TICKETS AVAILABILITY. The tickets will only be available for Africa Rising 6 to be held on 5 and 6 September, 2023.

Use of Services

Registration with the Website: You are not required to register with the Website in order to access and use certain features of the Services. If you choose to register for the Services, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the Services’ registration form. Registration data and other information about you are governed by this T&C and our Privacy Policy and the law. If you are under 18 years of age, you are not authorized to use the Services, with or without registering. In addition, if you are under 18 years old, you may use the Services, with or without registering, only with the approval of your parent or guardian. You acknowledge and agree, including but without limitation to the following: (a) to comply with all the notices, guidelines, rules and instructions in relation to the use of the Services as issued by IAA from time to time, including but not limited to all specific terms and conditions governing use of specific aspects of the Services and any amendments and modifications, operating rules, guidance or policies that may be published from time to time by IAA; (b) to abide by all applicable laws and regulations in your use of the Services; (c) where it is the case, not to share or disclose your access user name and/or password to any other party; (d) not to impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity; (e) not to upload or distribute in any way files which you know or have reason to suspect contain viruses, corrupted files or any other similar software, programs, macros or files that may detrimentally interfere with the Services; or to do anything which would create or impose an unreasonable or disproportionately large burden or load on the Website; (f) not to gather and use the information for unsolicited advertising or other unsolicited purposes; (g) not to use the Services for illegal purposes; (h) where it is the case, if you get access to the list of other delegates or in whatever circumstance, not to post or transmit “spam” mail or engage in any unsolicited mass distribution of email or to transmit any unsolicited advertising in any form whatsoever; (i) where it is the case, not to post, promote or transmit information through the Services which may infringe the rights of any third party, whether in statute or at common law, including but is not limited to any third party’s copyright, patent, trademark, trade secret or proprietary rights or rights of publicity or privacy; (j) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover the source code of any software that is used in connection with the Services. At all times, IAA reserves the right to disclose any information as IAA deems necessary to satisfy any applicable law, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in IAA’s sole discretion.

Non-commercial use of the Website

Unless otherwise specified, the Website is for your personal and non-commercial use. You may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works or materials from, transfer, or sell any information, software, products or services obtained from the Website. Without the advance express written permission of IAA, you may not ‘meta-search’ the Website, send, or cause to be sent, any automated queries of any sort to the Website, or use the Services in any commercial manner without our prior express written consent.

Restricted use of the Website

You acknowledge and agree that you will not use the Website for any purpose that is unlawful or prohibited by the T&C. You may not use the Website in any manner that could damage, disable, overburden, or impair any website(s), network(s) connected to the Website, or interfere with any other party’s use and enjoyment of any Service. You may not attempt to gain unauthorized access to the Website, other accounts, computer systems or networks connected to the Website, through hacking, password mining or any other legal or illegal means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Website.

Access suspension or termination

It is understood and agreed that IAA reserves the right, in its absolute sole discretion, to restrict, suspend or terminate your access to the Website and the related services or any portion thereof at any time, without any prior notice. Upon termination of your Website access, your right to use the Website immediately ceases. IAA shall have no obligation to maintain any content.

Linking and Links to Third Party Sites

If anyone would like to insert a hyperlink to the Website (or any part thereof) on any of their website(s) or webpage(s) or ‘mirror’ any material contained on the Website on any other server, prior written permission is required from IAA. The Website may contain links to third party websites (“TPS”). The TPS may or may not be under any control of IAA. Consequently, IAA cannot accept any responsibility for the contents of or the consequences of accessing any linked website(s), including without limitation any links contained in a TPS, or any changes or updates to a TPS. You acknowledge and agree that IAA is not responsible for any content or webcasting or any form of transmission received from any TPS nor is IAA responsible if any TPS is not working appropriately. IAA is providing the link(s) to you only as a convenience, and the inclusion of any link(s) does not imply endorsement by IAA of that site(s) or any association with its operator(s). You understand that you are responsible for viewing and abiding by the privacy statements and terms of use posted at that respective TPS.

Tickets & Reservations for Events

The following part details the process relating to acquiring or purchasing tickets or registering for events on this Website, including various terms and conditions applicable during an event organized by IAA. However, it should always be read in conjunction with the entire T&C and the Privacy Policy on this Website. All ticket sales are subject to the T&C and our Privacy Policy. At any time, if you do not agree to the these and/or do not consent to such use and disclosure, please cease to access or use the Services available on or through this Website. When you purchase a ticket or register for any event(s) organized by IAA you are expressly giving your full consent to comply with and be bound by the T&C herein and the Privacy Policy. IAA reserves the right to change the T&C and the Privacy Policy, including but not limited to the ticket prices and the fees associated with the use of the Website at any time with or without prior notice. Any amended or further modified T&C will be posted on this Website. Consequently, we advise you to check this Website from time to time and our Services.

Special Conditions related to Tickets

All orders are subject to availability and acceptance by IAA. IAA reserves the right to accept or reject any order without providing any reason for such a decision. By ordering Tickets, the purchaser shall agree, on his/her own behalf and as agent on behalf of all persons for whom he/she is purchasing Tickets or who will be holding Tickets purchased by he/she (“Ticket Holder”), to be bound by these T&C and the Privacy Policy. Ticket prices, promotions and discounts may change during a sale period and they may differ from an event to another, as determined in its sole discretion by IAA. No refunds will be given or claims entertained due to any change in Ticket prices, including but not limited to promotional prices, discounts or whatever special offers, except as mentioned in this T&C. Most of our events would be recommended and restricted to participants of at least 18 years old due to the complexity of the matters and the higher level of discussions involved which may be difficult to be understood by some participants, especially young ones. Under special circumstances and at the IAA’s representatives discretion participants under 18 years may be admitted at an event provided they possess a valid access document either a paid ticket or a free or subsidized ticket and they must be accompanied by an adult with a valid ticket. Anyone who fails to comply with these requirements may have their access restricted. Upon confirmation of your order for Tickets, no refund and/or no exchange of Tickets will be entertained under any circumstances and Tickets are not transferable, except as mentioned in this T&C at the full discretion of IAA. The resale of Tickets at any price is prohibited. IAA reserves the right to cancel any Tickets that have been transferred or resold and to deny any such Ticket Holder entry. The tickets purchased are for your own personal use or that of your business only and may not be re-sold or transferred for commercial gain under any circumstances, including but not limited to use as part of any promotion or competition, without IAA’s prior written consent Where there has been any re-sale or attempted re-sale of any tickets (or any other breach of this T&C), we reserve the right to cancel the relevant tickets with immediate effect. We also reserve the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket broker or tout. Tickets are delivered in electronic format via email to the email address nominated by the purchaser. If a purchaser buys several Tickets online, the electronic tickets will not be sent until the purchaser has provided for each beneficiary of a ticket his/her details, such as email address, mobile phone number and mail address. The online form may provide additional fields to input these details if available at the time of purchase. If not available, the details have to be communicated as soon as possible to our contact email/ or using the form in the Website, but not later than the cut of day before the event as per this T&C.

Specific conditions regarding access and registration to an Event

No photography, audio or video recording is allowed during the events, unless otherwise advised by IAA. IAA may use the Ticket Holder’s image or likeness in any live or recorded video display, photograph, picture or publicity material or website. IAA has the right to postpone, cancel, interrupt or stop an event due to adverse justified situation such as weather, pandemic or widespread epidemic, dangerous or terrorism situations, unexpected issues with the location, if a speaker is prevented from participating due to a medical emergency, or any other causes beyond his reasonable control. IAA will notify the participants of the new details of the event, which will be organized within 1 year of the original event. It is understood and agreed that while the speakers’ presentation at an event is with the consent of IAA, IAA assumes no responsibility for the accuracy or appropriateness of any information provided at the event by any speakers and his/her points are their own points, not necessarily endorsed by IAA. IAA may also add, withdraw or substitute any speaker(s) and/or vary advertised programs, without prior notice. IAA shall notify you in writing of the changes made and you shall not be entitled to any claim for a refund or for any costs, expenses, losses, damages or liabilities which may be incurred or suffered by you as a result of such cancellation or amendment or changes. IAA shall not be liable for any delay and/or failure to deliver to you any updated information and/or services resulting from your failure to supply a valid email address and the accurate contact details. IAA does not accept and would not tolerate harassment of any kind towards our users and event participants in any form and we expect that all participants to conduct themselves in a civilized, professional and appropriate manner. Any participants to any of our events who does not comply with these rules may be sanctioned or expelled from the event, without a refund, at the discretion of the event organizers.

Refunds and Alterations

This part of the T&C is more relevant to the unfortunate situation when an event has to be postponed, cancelled or substitute with another event for whatever reason. IAA may cancel an event for any reason whatsoever by written notice to you. If any Services, or specifically event(s), are postponed or cancelled by the Organizer, an official notice shall be placed in the media and/or on this Website by IAA in that respect. In the unlikely situation of cancellation of an event, IAA assumes no responsibility for any loss or damage as a result of a substitution, alteration, cancellation or postponement of an event. IAA shall assume no liability whatsoever in the circumstances that an event is cancelled, rescheduled or postponed due to a force majeure (as such is further defined below) or fortuitous situation, unforeseen occurrence or any other event that renders performance of an event impracticable and impossible. For purposes of this clause, a fortuitous event shall include, but not be limited to: fire, labor strike, extreme, weather, or another emergency. You acknowledge that you shall not be entitled to and shall not claim a refund other than by strict compliance with this T&C and the law. Name changes will be permitted free of charge. IAA shall have no other liability or obligations for any other costs, expenses, losses, damages or liabilities which may be incurred or suffered by the purchaser or the Ticket Holder as a result of such cancellation. For the avoidance of doubt, IAA doesn’t accept any refund as a result of your late registration or withdrawal from, the event. Likewise, if you have secured a complimentary ticket but have already bought a ticket, you are not eligible for a refund.

Speaker substitution

It acknowledged and agreed that while speakers and topics are confirmed at the time of publishing, circumstances beyond the control of the Organizer may necessitate substitutions, alterations or cancellations of the speakers and/or topics. As such, IAA reserves the right to alter or modify the advertised speakers and/or topics, if necessary, without any liability to you whatsoever. Any substitutions or alterations will be updated on our web page as soon as possible.

Consent to record and store your personal data

The user of this Website understands and gives express consent for the mandatory and voluntary data collected from he/she in the course of purchasing and or registering for tickets sold by IAA (and/or other associated companies as the case may be). The user and/or purchaser and/or Ticket Holder further give their permission for their user account(s) details to be stored by IAA. It is agreed that IAA shall be given a reasonable timeframe to remove any personal details at any time that the user and/or Ticket Holder no longer wish them to be stored. The user of the Website and/or purchaser and/or Ticket Holder acknowledges and accepts that their data will be used for commercial purposes in accordance with this Private Policy and T&C and can be retained and stored for this purpose. Any request for the data to be removed has to be addressed in writing to IAA or to dpo@iaa.org. Any requests will be usually processed within a 30-day period.

Consent to participate in online/offline surveys

The user of the Website and/or purchaser and/or Ticket Holder hereby gives consent for IAA to store any voluntary information provided to IAA in the course of participating in an online survey from time to time. It is also acknowledged and accepted that the data may be used for commercial purposes in accordance with this T&C and the Private Policy and will be retained and stored for this purpose.

Complementary, subsidized tickets and Consent for processing data

IAA believes that each of us should have equal opportunities to develop our dreams and ideas. There are also people who can help our event or further events in many ways. We offer regularly free and/or subsidized Tickets to our events from time to time. It is a condition of these promotions that only individuals who meet our requirements gain admission to the event using this type of tickets. These tickets are personal and non-transmissible. IAA will publish from time to time the criteria and requirements to qualify for such a Ticket. Please contact IAA directly for more details. The user of the Website and/or purchaser and/or Ticket Holder, including the complementary or voluntary ticket holder, hereby gives consent for IAA to use for the purposes of processing ticket registration, including complementary ticket, the mandatory data and any voluntary data provided when registering a complimentary admission ticket. It acknowledged and accepted that this data can be used at IAA’s discretion for commercial purposes in accordance with this T&C and the Private Policy and that the data will be retained and stored for this purpose. At the discretion of IAA complementary or subsidized tickets may be offered before the event start date. In these instances, if the attendee had not been directly nominated, tickets must be assigned to an attendee within 3 days of the receipt the complementary or subsidized ticket, and all attendee details must be fully complete in the form provided online or by email no later than 14 days before the event starts. For the avoidance of doubt, this includes name, job title, company name and a passport style photo, if applicable. Any ticket reassignment after this date is prohibited. It expressly understood that any complementary or subsidized tickets cannot be sold or resold as doing so will void the ticket and the Ticket Holder may not be allowed to enter to the event. Our complementary and subsidized ticket offers sometimes include a processing fee. This fee is non-refundable in its entirety. If you have secured a complimentary ticket but have already bought a ticket, you are not eligible for a refund.

No Warranties and Limitation of Liability

The Services, including the Website and all information, including but not limited to text, graphics and hyperlinks, materials, services and functions contain therein are provided on a “as is” and “as available” basis for your information and personal use and enjoyment only. No warranty of any kind, implied, express, contractual or statutory, including but not limited to any warranties of title, non-infringement of third party rights, merchantability, satisfactory quality, accuracy, fitness for a particular purpose and freedom from computer virus or other malicious and harmful components, destructive or corrupting code, agent, program or macros, is given in conjunction with the Website, or any information and materials provided at the Website or throughout the events promoted at the Website. IAA does not warrant and shall in no event be liable for any damages, loss or expense (including but not limited to direct, indirect, special, circumstantial, consequential or punitive damages, loss of profits, loss of business, loss of opportunities, loss of goodwill or cost of cover) arising in any way from or in connection with (a) the accuracy, timeliness, adequacy or completeness of the information, materials, services and/or functions provided at or contained in the Website; (b) the access, use or inability to use and/or access to the Website, the Services and/or any information or any materials on the Website will be uninterrupted, secure or free from errors, defects, mistakes or omissions or that any identified defect will be corrected immediately; (c) that the Website or any information or materials provided therein will meet your requirements or are free from any virus or other malicious, deletions of files, delay in operations or transmission, non-delivery of information, disclosure of communication, destructive or corrupting code, agent, program or macros, any system, server or connection and/or performance failure; (d) any services, products, information, data, software, or other materials obtained, printed or downloaded from IAA or from any other website or webpage linked to the Website or from any other party referred by the Website; (e) any dispute arising between you and any third party service provider of Website, even if IAA has been advised of the possibility of such damages, losses, or expenses; and (f) that use of materials displayed on Website will not infringe rights of third parties. This paragraph shall take effect to the fullest extent permitted by law. You acknowledge and agree that IAA (and/or its suppliers, where it may be the case,) shall not be liable and there is no warranty in relation to the security of any information transmitted by or to you using the Website or any other means such as our emails, messages, letters and newsletters or any other sort of communication, announcement or notice, and you hereby accept the risk that any information transmitted or received, as mentioned above, may be accessed, copied, modify, altered, distributed by unauthorized third parties and/or disclosed by IAA and its shareholders, officers, employees, or agents to third parties purporting to be you or purporting to act under your authority. It is also agreed that you will not hold IAA or any of its shareholders, officers, employees, advisers or agents responsible or liable, in contract, tort (including negligence or breach of statutory duty), equity or otherwise, for any such access or disclosure or for any damages, losses, expenses, or costs whatsoever (whether direct or indirect, or whether foreseeable or not) suffered or incurred by you as a result of any such access, use of the Website or disclosure. You should also understand and agree that some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages and the above limitation may not apply to you. However, if you are dissatisfied with any portion of the Website, or with any of these T & C, your sole and exclusive remedy is to discontinue using the Website or our Services. You also specifically agree that IAA is would not be responsible nor liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another’s rights, including intellectual property rights on this Website or during the provision of the Services or at any event organized by IAA.

Independent Business decisions

You acknowledge and agree that any purchase, business decisions, financial, legal, personal or medical decisions following an advice received via the Website or your attendance to an event are not influenced by any prior relationship or dealings with IAA or any of its officers, directors, employees, advisors or representatives. Should you enter into a contractual relationship with any speaker(s) and/or any IAA representative(s) at/or subsequent to an event, you do that at your own risk, and acknowledge that IAA has neither responsibility for, nor any liability with regards to, any contracts or relationships entered into between yourself and the respective speaker(s) and/or IAA’s representative(s).

User’s Indemnity

You acknowledge that, to the extent permitted by applicable law, you agree to release and waive any and all claims and/or liabilities against IAA arising from or in connection with your use of the Website or the Services, including to accept full responsibility of your purchase, participation and/or the outcome of any decisions made after attending any of IAA events. You also agree to defend and fully indemnify IAA, its shareholders, officers, employees and advisors or representatives against all actions, claims, obligations, liabilities or potential liabilities, damages, losses, costs and expenses, including legal fees arising (i) from your use and access to the Website or the Services; (ii) from your breach of the provisions of this T&C herein; and/or (iii) in connection with your use of the Website brought against IAA by another user, third party providers or any third party, including without limitation any copyright, property, or privacy right.

Intellectual Property

All trademarks, copyright and other intellectual property and proprietary rights in this Website and in this event organized by IAA, protected by prior official registration or not, including but not limited to text, software, code, scripts, internet sites, music, sound, photographs, video, graphics, graphical user interface, forms, diagrams or any other support, content or material contained in the Website or presented to any event (subject to the rights of the speaker(s) or presenter(s)) or developed as a result of the event shall belong to IAA or other third party content providers if it was the case and you are permitted to use this material only as expressly authorized by IAA to do so. (“Content”). You may save, download or print the Content solely in connection of your personal use of the Website and for non-commercial purposes. You may access materials displayed on the Website any time they are available for your non-commercial use only provided that you also always retain all copyright and other proprietary notices contained on their respective materials. You may not, however, sell copy, reproduce, distribute, modify, display, transmit, reuse, re-post, or otherwise use the Content for any public or commercial purposes or for longer than necessary, without IAA’s prior written permission. Meanwhile, if you have a valid claim regarding any material contained or published on this Website, you are welcome to contact us with the relevant evidence and we will analyze be receptive to rectify, amend and/or remove from our Website that element. In any respect, IAA reserves all rights not expressly granted in and about the Website and the content and materials herein.

Records

You acknowledge and agree that IAA’s records relating to or connected to your use, access, communication, transactions, instructions or operations of the Website or the Services shall be binding on you for all purposes whatsoever and shall be conclusive evidence at such communications, transactions, instructions or operations. You agree that such records are admissible as evidence and that you shall not challenge or dispute the admissibility, reliability, accuracy or the authenticity of the contents of such records merely on the basis that such records were in electronic form or were produced by or are the output of a computer system, and consequently, hereby you have waived any of your rights (if any) to object in this respect. You agree to receive the CREATIVITY4BETTER newsletter with information from industry leaders, business gurus, amazing entrepreneurs and ultimate technology and marketing trends and the updated offers from all Creativity4Better events. You agree to receive the latest info and offers about CREATIVITY4BETTER events also when you are on other websites. For this, you agree to allow cookies and other online digital marketing tools to personalize site content, social media features and to analyze the traffic by sharing my navigation status with IAA advertising and social media partners such as Facebook, LinkedIn and Google. You agree to share your email address and data with IAA partners.

Force Majeure

IAA shall not be responsible, nor liable for non-performance, cancellation, error, interruption or delay in the performance of its obligations, in the Website’s operation, in the provision of the Services (or any part thereof) or for any inaccuracy, unreliability or unsuitability of Website’s contents if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond IAA’s reasonable control which includes without limitation: (a) any natural calamities, including but not limited to earthquake, floods, land-sliding, lightning, Acts of God, pandemic or wide-spread epidemic, fire and other natural disasters; (b) war or acts of terrorism; (c) local or foreign judgments, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; (d) power failure, acts or defaults of any telecommunications network operator or when communication lines cannot be used; and (e) acts or omissions of any third party service provider or a party for whom IAA is not responsible. If an event is cancelled because of an Act of God, pandemic or wide-spread epidemic, inevitable accident, fire, blackout, weather, flood, or any other calamity, or if by reason of terrorism, terrorist threats, riots, strikes or lockouts, or any other events beyond the direct control of IAA, IAA may, at its option postpone the event from the original schedule. The participants, including Ticket Holders shall not be entitled to claim for a refund or for any costs, expenses, losses, damages or liabilities which may be incurred or suffered by them as a result of such unfortunate postponement.

Notices

Any notices, demands or other official communications, may be deemed served by IAA (or our agents or advisers) on you by posting them on this Website or by direct email or recorded mail. If sent by email, when sent to your email address notified to IAA in writing during your access or registration with the Website and shall be effective on the date and time of transmission by the mail server operated by IAA and/or its service provider unless IAA receives the automatic a non-delivery or any error reply message indicating that the email was not successfully sent to your mailbox. From time to time, IAA may designate and prescribe in this T&C other methods of giving notices, including but not limited to any form of communication or transmission such as Facebook, Twitter, SMS etc. and the time or event by which such notice shall be deemed given.

General Disclaimer

Neither IAA nor any of its content providers shall be liable for any errors or delays in the content furnished during the provision of the Services or on the Website, or for any actions taken in reliance thereon. IAA assumes no obligation to monitor, screen, censor or review transmissions, and the like on the Website, and disclaims any responsibility or liability arising from the content or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, inaccuracy or any other objectionable material contained in any information within the Website.

Severability

Should any provision(s) or part thereof of this T & C is held to be invalid or unenforceable, such provision or part thereof shall be struck off and the remaining provisions shall be unaffected and enforced. Governing Law By accessing this Website and/or using the Website and any Services, you have acknowledged and agreed that New York law (including without limitation, the provisions of the Evidence Act and the Electronic Transactions Act shall govern such access and that this T&C together with the Privacy Policy shall be construed and governed by New York, USA law.

General Consent

By continuing to access and use this Website, you have acknowledged and hereby confirm that you have agreed and given your full consent for IAA to contact you, as the case may be, by Facebook, phone, email, SMS, or other means in regards to any Ticket purchase and/or registration for the Services, including for future opportunities or events even if your telephone number is on the National Do Not Call Registry. You have further understood and have given your express consent to your email address to be included in IAA’s mailing list for the main purposes of notification of products and/or services being offered to you by IAA and/or its group, partners.
